Supreme Court Filing Warns Ending Birthright Citizenship Would Create Stateless Americans

Asbury Park, NJ– March 3, 2026– United Stateless is proud to co-lead an amicus brief to the U.S. Supreme Court in Barbara v. Trump, demonstrating that ending birthright citizenship will newly create a class of stateless people born in the United States. The brief, co-led by the Global Strategic Litigation Council and joined by 49 partner organizations, explains that ending birthright citizenship will dramatically expand the number of stateless people in the United States and the harms that those individuals are likely to face. It highlights the harms faced by groups like asylum-seekers and LGBTQI individuals, and identifies the international legal obligations that President Trump's Executive Order violates.
Karina Ambartsoumian-Clough, Executive Director of United Stateless, said: "As stateless people in the United States, we know all too well what it means to live in this country without a nationality. We urge the Court to consider that President Trump's order would expand the number of people who, like us, will fear immigration enforcement, being separated from their families, and facing uncertainty in our jobs and communities."
Betsy Fisher, advocacy counsel for United Stateless said:Â "President Trump seeks to upset the long-established understanding of the Fourteenth Amendment, which means what it says: people born in the United States are U.S. citizens in almost all situations. The experience of stateless people in the United States demonstrates why the Fourteenth Amendment is so important."
